"Attempts to gain public recognition of this issue and promote necessary changes in laws, policies and practices have been going on for a number of years. In May 2007, ten mothers, one victimized child (now an adult), and leading national organizations filed a complaint against the United States with the Inter‐American Commission on Human Rights (IACHR). The complaint detailed several cases where there was documented medical evidence of child sexual abuse, but in each case the abusive father was given full custody of the children he abused. Several years earlier, the American Civil Liberties Union (ACLU) had filed a petition against the United States with IACHR for their failure to protect Jessica Gonzales’ three children from their abusive father, who ended up murdering them. Thi s petition was the first of its kind; asserting that domestic violence victims had the right to be protected by the state from the violent acts of their abusers."
"In today’s society, millions of children experience family break‐ups from divorce, separation, and desertion and many of these children witness and/or become victims of abuse while living with their parents. A fairly recent body of literature reveals that if violence exits in relationships, and victims attempt to terminate a relationship, custody disputes may be employed by abusive partners to maintain control of victims. In most cases, the perpetrator is a male and the victim is his female partner."
